$32 Million Verdict Against Walmart for Retaliation

In January of 2016, a New Hampshire judge issued a verdict against Walmart to the tune of roughly $32 Million for allegedly retaliating against a pharmacy employee for one of the New Hampshire Walmart stores, who was whistle-blowing to the New Hampshire pharmacy board, as well discriminating against her gender and medical condition.

In a consumarist.com article by Chris Moran (Link: https://consumerist.com/2016/01/29/walmart-ordered-to-pay-31-million-for-retaliating-against-pharmacist-whistleblower/ ), Moran outlines the background of this case, which started in 2014 and the events of which began to unfold in 2012.

Plaintiff worked in pharmacy and felt that the pharmacists were poorly trained and were not receiving high quality support from Walmart, to the point where she had to blow the whistle to the New Hampshire Board of Pharmacy. She also alleged that a “serious dispensing error” occurred, which her superiors tried to pawn off on her, until it was ultimately proven that the Plaintiff was not at fault.

Moran’s article further states: “According to the plaintiff, the stress of the job, and the lack of support from Walmart, got so bad that she had lost 18 pounds, was having headaches, gastrointestinal symptoms, anxiety, and depression. She says she needed prescription medication to sleep at night.”

The jury concluded that Walmart’s actions violated the Civil Rights Act as well as New Hampshire state law and found in favor of the Plaintiff. For a more detailed account of the facts in this case, we encourage you to read Mr. Moran’s article, linked above.
