According to an National Law Review article dated August 17, 2016 by the U.S. Equal Employment Opportunity Commission (EEOC), Walmart has agreed to a $90,000 settlement to a former employee from the Rockford, IL Walmart store. Additionally, the lawsuit alleged that Walmart violated employment discrimination law by firing an intellectually disabled worker from one of it’s stores. Specifically, Walmart is alleged to have violated the Americans with Disabilities Act (ADA) by not providing a reasonable accommodation to enable the disabled workers to perform his job duties. The accommodation that the worker, Mr. Clark, was asking for was a simple written task list of his job duties, which would allow for him to be an effective employee for the Walmart store.
Walmart’s Consequences For It’s Store’s Alleged ADA Law Violation:
The firing and failure to provide accommodation led to two conditions of the settlement of Walmart with the EEOC.
- The first is the $90,000 monetary payment to Mr. Clark.
- The second condition is a two-year decree under which Walmart will train its employees on employment discrimination and making reasonable accommodations under the ADA.
